At Vivid Qi, we are committed to maintaining the privacy and security of your protected health information (PHI). This Privacy Policy explains how we collect, use, disclose, and protect your information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and Florida state laws, including Florida Statutes §§ 456.057, 395.3025, and 381.004.

  • Health Information: Diagnoses, treatment records, physician notes, test results, medications, allergies, and other relevant data.

  • Insurance/Billing Information: Health insurance details, billing information, and payment history.

  • Provide medical treatment and coordinate your care.

  • Communicate with you regarding appointments, test results, and follow-up care.

  • Submit claims and receive payment from your insurance provider.

  • Maintain clinic operations, including quality improvement and internal auditing.

  • Comply with federal and state public health, safety, or legal obligations.
     

3. How We Share Your Information

Your information may be shared only as permitted by HIPAA and Florida law, including:

  • Healthcare providers involved in your treatment.

  • Insurance companies for billing and reimbursement.

  • Public health authorities as required (e.g., for communicable disease reporting).

  • Legal entities under court orders or subpoenas.

  • With your written authorization for uses not otherwise permitted.
     

Florida-Specific Notes:

  • Under Florida Statute §456.057, your medical records are confidential and may only be shared without your written authorization in very limited circumstances.

  • Psychotherapy notes and HIV/AIDS test results require specific written consent for disclosure.

  • You have the right to authorize or deny the release of your records to third parties, including attorneys or family members.
     

4. Your Rights Under HIPAA and Florida Law

You have the right to:

  • Inspect and obtain a copy of your medical records (within 10 business days of your request under Florida law).

  • Request amendments to your medical information.

  • Request restrictions on how your information is used or disclosed.

  • Receive confidential communications through preferred channels.

  • Request an accounting of disclosures made without your consent.

  • File a complaint without fear of retaliation if you believe your privacy rights have been violated.
     

5. Data Security and Communication Preferences

We use physical, technical, and administrative safeguards to protect your personal and health information from unauthorized access, use, or disclosure. These measures include secure electronic medical record systems, encrypted communications where appropriate, staff training, and access controls.

SMS (Text Message) Communications

We may offer the option to communicate with you via SMS (text messaging) for purposes such as:

  • Appointment reminders

  • Test result notifications

  • Prescription refill alerts

  • General health and wellness information
     

SMS Consent Required:
You will be asked to opt in to receive SMS messages. Participation is completely voluntary and will not affect your care.

If you opt-in to receive SMS notifications from AcuBliss on behalf of your medical provider, Acubliss will send text message reminders and notifications to the mobile number you have provided regarding your upcoming appointments and other healthcare reminders and alerts. By opting in to receive SMS notifications, you consent to us collecting and using your mobile phone number for this purpose. Acubliss will not sell, share or use your phone number for any other purpose without your permission.

You can opt-out of receiving SMS notifications at any time by replying STOP to a text message from us or by managing your preferences within the patient portal or by contacting your medical practice directly. Standard SMS message and data rates may apply according to your mobile carrier plan.

AcuBliss does not sell or share personal information such as your mobile phone number or the content of your SMS notifications for third party sales, marketing or advertising purposes.

Additionally, Vivid Qi staff may provide SMS communication regarding general information pertaining to practice operations. Such as, providing hours of operation, directions, and parking instructions. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties

Message and data rates may apply depending on your mobile carrier. We will never send sensitive health information via SMS without your explicit consent.

We respect your communication preferences and will honor your choices.

 

6. Retention of Medical Records

Per Florida law, we retain adult medical records for at least 5 years following the last patient contact. For minors, records are retained for 5 years after the child reaches age 18, unless otherwise specified.

 

7. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted in our clinic and on our website. The effective date above will always reflect the most recent version.
